Creditors take personal guarantees to strengthen their position. In our experience very few clients are able to answer the question, “Who have you personally guaranteed?” with any degree of certainty.
Help your client understand who they have guaranteed and what this could mean. Clients are often shocked to discover how much they are liable for and what they have agreed to with the creditor. We think you could add a lot of value to your client relationship by helping your client build a register of personal guarantees. Who? How much? What rights have I given them? Who can put a caveat on my home?
